Press Statement No. 40-2023_SUHAKAM Commends Government’s Progress on Foreign Workers’ Management Report, Urges Swift Action on the Recommendations

KUALA LUMPUR (25 OCTOBER 2023) –The Human Rights Commission of Malaysia (SUHAKAM) welcomes the release of the long-awaited ‘Report of the Independent Committee on the Management of Foreign Workers’ which was recently released after it was completed in 2019. SUHAKAM commends the Government’s progressive move by taking this crucial step towards addressing the longstanding issue of forced labour in Malaysia.

SUHAKAM wishes to extend its appreciation to the Independent Committee, led by a retired Judge of the Court of Appeal, Dato’ Seri Mohd Hishamudin Md Yunus, alongside committee member Mr. Jerald Joseph, both former Commissioners of SUHAKAM who had displayed unwavering commitment in addressing foreign workers management issues and underscored their dedication to resolving human rights concerns. 

With the release of the independent report, SUHAKAM reiterates its call on the Government to expedite implementation of the recommendations which include issues of unethical, unhealthy, and unfair practices in the recruitment of foreign workers and to comprehensively reform relevant policies relating to recruitment, employment and monitoring of foreign workers in Malaysia.

In addition to this, SUHAKAM also calls on the Government to expedite the development of Malaysia’s National Action Plan on Business and Human Rights (NAPBHR), emphasizing the importance of business entities respecting human rights. The NAPBHR should be guided by the UN Guiding Principles on Business and Human Rights (UNGP BHR), reflecting a commitment to accountability in business practices, benefiting both people and the planet.

SUHAKAM remains dedicated to upholding human rights and supporting initiatives that contribute to a just and ethical society. We look forward to continued collaboration with the Government and other stakeholders in addressing these important issues.

SUHAKAM Puji Usaha Kerajaan dalam Laporan Pengurusan Pekerja Asing, Gesa Pelaksanaan Segera Saranan

KUALA LUMPUR (25 OKTOBER 2023) – Suruhanjaya Hak Asasi Manusia Malaysia (SUHAKAM) menyambut baik pendedahan ‘Laporan Jawatankuasa Bebas Pengurusan Pekerja Asing’ kepada umum setelah ia dilengkapkan pada tahun 2019. SUHAKAM memuji langkah progresif kerajaan ke arah menangani isu buruh paksa yang telah sekian lama wujud di Malaysia.

SUHAKAM ingin menzahirkan penghargaan kepada Jawatankuasa Khas yang diketuai oleh mantan Hakim Mahkamah Rayuan, Dato’ Seri Mohd Hishamudin Md Yunus bersama dengan salah seorang Ahli Jawatankuasa, Encik Jerald Joseph. Kedua-duanya adalah mantan Pesuruhjaya SUHAKAM yang telah menunjukkan komitmen yang tidak berbelah bahagi dalam menangani isu-isu pengurusan pekerja asing dan sentiasa berdedikasi dalam memperjuangkan isu hak asasi manusia.

Dengan pendedahan laporan bebas ini, SUHAKAM ingin mengulangi seruan kepada Kerajaan untuk mempercepatkan pelaksanaan syor Jawatankuasa yang meliputi isu amalan tidak beretika, tidak sihat dan tidak adil dalam proses pengambilan pekerja asing dan untuk memperbaharui secara menyeluruh, dasar-dasar yang berkaitan dengan proses pengambilan dan pemantauan pekerja asing di Malaysia.

Dalam hal ini, SUHAKAM juga ingin menggesa Kerajaan untuk mempercepatkan pembangunan Pelan Tindakan Nasional Malaysia Mengenai Perniagaan dan Hak Asasi Manusia (NAPBHR) yang akan meletakkan tanggungjawab ke atas entiti perniagaan untuk menghormati hak asasi manusia. NAPBHR harus teguh berpandukan Prinsip Panduan PBB mengenai Perniagaan dan Hak Asasi Manusia (UNGP BHR), yang menekankan komitmen terhadap akauntabiliti amalan perniagaan kepada manusia dan alam.

SUHAKAM kekal teguh menegakkan hak asasi manusia dan menyokong inisiatif yang menyumbang ke arah masyarakat yang adil dan beretika. Kami akan terus bekerjasama dengan Kerajaan dan pihak berkepentingan lain dalam menangani isu-isu penting ini.
