Press Statement No.3-2024_Embracing Democracy and Human Rights-Supporting Indonesian General Election in Malaysia

PRESS STATEMENT

KUALA LUMPUR (7 FEBRUARY 2024) — SUHAKAM acknowledges and commends the Indonesian Embassy’s initiative in organizing the voting process for the Indonesian General Elections 2024 (PEMILU) in Malaysia. The establishment of multiple voting centers across Malaysia on 12th February 2024, highlights the strong democratic values shared by both nations.

The historical relationship between Malaysia and Indonesia is deeply rooted in mutual support and cooperation, especially in preserving democratic processes. This collaboration is a vital component of not only our bilateral ties but also the broader ASEAN community, committed to fostering a culture of dialogue and respect for human rights. ASEAN’s dedication to human rights, as enshrined in the ASEAN Charter and the ASEAN Human Rights Declaration, corresponds closely with the principles outlined in the Universal Declaration of Human Rights (UDHR). Supporting democratic processes, such as the forthcoming Indonesian election in Malaysia, serves as a tangible expression of these shared values.

It is pertinent to emphasize the right to vote as a fundamental human right, integral to democratic governance, civic participation, and regional stability. Although Malaysia is not a signatory to the International Covenant on Civil and Political Rights (ICCPR), the core principles within it resonates with our own dedication to human rights and democracy. Article 25 of the ICCPR explicitly states that every citizen has the right to engage in the conduct of public affairs, directly or through freely chosen representatives, and to vote and be elected at genuine periodic elections. This underscores the universality of the voting right, transcending national boundaries and political affiliations.

Therefore, to ensure a conducive environment for the Indonesian electoral process in Malaysia SUHAKAM calls upon Malaysian authorities to provide in assistance to smoothen the voting process, ought to mirror the noble principles under the ASEAN Charter, ASEAN Human Rights Declaration as encapsulated in the UDHR, which are symbiotically reflected in PEMILU’s model on multiple voting centres proposed to be implemented locally via-a-vis the Indonesian General Election 2024. By providing a free, fair, and unhindered election, we demonstrate our shared values and commitment to human rights and democracy and showcase regional solidarity and support for our Indonesian neighbours.

SUHAKAM also encourages all Malaysians to display their support and understanding during this crucial event, further extending the spirit of goodwill and unity in the ASEAN community. SUHAKAM extends our best wishes to all Indonesian voters in Malaysia. The participation significantly contributes to the democratization of the region and reflects both country’s mutual commitment to upholding human rights and democratic principles.

Mendukung Demokrasi dan Hak Asasi Manusia-Menyokong Pilihan Raya Umum Indonesia di Malaysia

KUALA LUMPUR (7 FEBRUARI 2024) SUHAKAM memuji inisiatif Kedutaan Besar Indonesia dalam pengurusan proses pengundian Pemilihan Umum Indonesia 2024 (PEMILU) di Malaysia. Penubuhan pusat-pusat pengundian di seluruh Malaysia pada 12 Februari 2024 mencerminkan nilai-nilai demokrasi yang kukuh antara kedua-dua negara.

Hubungan baik antara Malaysia dan Indonesia berakar umbi daripada sokongan dan kerjasama, terutamanya dalam pemeliharaan proses demokrasi. Kerjasama ini adalah komponen penting bukan sahaja dalam hubungan bilateral tetapi juga sebagai sebahagian daripada komuniti ASEAN yang komited dalam pengukuhan budaya dan penghormatan hak asasi manusia. Iltizam ASEAN terhadap hak asasi manusia, sebagaimana termaktub dalam Piagam ASEAN dan Pengisytiharan Hak Asasi Manusia ASEAN adalah selaras dengan prinsip-prinsip yang termaktub dalam Deklarasi Hak Asasi Manusia Sejagat (UDHR). Sokongan terhadap proses demokrasi pilihanraya Indonesia yang akan dijalankan di Malaysia ini jelas menggambarkan nilai yang dikongsi bersama.

Adalah penting untuk menekankan bahawa hak mengundi adalah hak asas yang penting untuk tadbir urus demokrasi, penyertaan sivik, dan kestabilan serantau. Meskipun Malaysia tidak menandatangani Kovenan Antarabangsa Hak Sivil dan Politik (ICCPR), prinsip teras Kovenan ini jelas terpamer dalam dedikasi Malaysia terhadap hak asasi manusia dan demokrasi. Artikel 25 ICCPR menyatakan bahawa setiap warganegara mempunyai hak untuk mengambil bahagian dalam hal ehwal negara secara langsung atau melalui wakil yang dipilih secara bebas dan berhak untuk mengundi dan dipilih melalui pilihan raya yang sah. Ini membuktikan  bahawa kesejagatan hak mengundi  adalah melangkaui sempadan dan juga pegangan politik.

Justeru, untuk memastikan proses pilihan raya Indonesia yang kondusif di Malaysia, SUHAKAM menyeru pihak berkuasa untuk membantu kelancaran proses pilihan raya tersebut. Ini seharusnya mencerminkan prinsip-prinsip yang terkandung dalam Piagam ASEAN, Deklarasi Hak Asasi Manusia ASEAN sebagaimana yang terangkum dalam Deklarasi Hak Asasi Manusia Sejagat (UDHR) sepertimana yang dicadangkan dalam model PEMILU melalui kepelbagaian pusat pengundian  untuk Pemilihan Umum Indonesia 2024. Dengan pilihan raya yang bebas, adil, dan tanpa halangan, Malaysia menunjukkan nilai dan komitmen terhadap hak asasi manusia, demokrasi serta solidariti melalui sokongan serantau kepada negara jiran.

SUHAKAM menggalakkan rakyat Malaysia untuk memberi sokongan kepada peristiwa penting ini dan memupuk semangat muhibah dan perpaduan dalam Komuniti ASEAN. SUHAKAM mengucapkan selamat mengundi kepada semua pengundi warganegara Indonesia di Malaysia. Penglibatan ini adalah sumbangan yang signifikan kepada proses demokrasi serantau dan mencerminkan komitmen kedua-dua negara dalam menegakkan hak asasi manusia dan prinsip demokrasi.

Press Statement No.2-2024_SUHAKAM Urges Government to Positively Assess All Recommendations Received from Malaysia’s 4th UPR

KUALA LUMPUR (26 JANUARY 2024) — SUHAKAM observed Malaysia’s Fourth Universal Periodic Review (UPR) at the 45th Session of the UPR Working Group in Geneva, Switzerland on 25 January 2024, and notes the range of human rights issues raised and recommendations received by Malaysia.

During the session, UN Member States recognised and welcomed the legal and institutional reforms implemented by the Government, which includes enhancement of rights protection for women, children and other vulnerable groups and strengthening of legislative reforms through the introduction of additional legal protections. A majority of UN Member States praised Malaysia for its decision to abolish the mandatory death penalty, which came into force on July 4, 2023. In addition, UN Member States also commended the Government’s efforts to empower SUHAKAM as the national human rights institution by providing the institutional strength required to effectively promote and protect human rights in Malaysia.

Among other key recommendations to Malaysia during the review included to abolish in total the death penalty; to increase the minimum legal age of marriage to 18 years old; to enhance the rights, protection and improvement of the well-being of older persons and persons with disabilities; to abolish corporal punishment in schools; to combat issues related to trafficking in persons; to develop a framework to protect refugees, undocumented and stateless persons;  to strengthen the social protection of vulnerable groups especially in rural areas; to ensure the conferment of Malaysian citizenship by Malaysian mothers to children born abroad; to repeal  or review security laws and laws that impede on civil liberties; accede to the remaining core  international human rights treaties and withdrawal of reservations to the treaties that have been  ratified.

Malaysia’s 4th UPR which was facilitated by Argentina, Eritrea and Vietnam who served as the ‘troikas’, witnessed reviews and recommendations from 130 United Nations (UN) Member States. SUHAKAM is of the view that the increased participation rate as compared to 111 UN Member States in Malaysia’s Third UPR in 2018 reflects a greater interest on human rights situation in Malaysia for this cycle.

At the national level, SUHAKAM hosted a hybrid forum in the Faculty of Law, University Malaya with a live streaming and panel session in conjunction with the session held in Geneva.  SUHAKAM moderated the panel discussion which has featured representatives from Pusat KOMAS (KOMAS), the Malaysian Islamic Youth Movement (ABIM), and the Office of the High Commissioner for Human Rights (OHCHR) South-East Asia Regional Office. SUHAKAM takes this opportunity to thank all participants for their contributions during the panel session which was aimed to raise awareness on the UPR process and served as a platform to discuss on critical human rights issues.

Having observed three previous cycles of the Malaysia’s UPR, SUHAKAM acknowledges the positive impacts it has made thus far. SUHAKAM calls upon the Government to positively assess the recommendations submitted and fulfil its commitment towards achieving the UPR’s objectives through a whole-of-society approach. SUHAKAM looks forward to the adoption of the outcome report on 31 January 2024, which will serve as a roadmap for Malaysia’s continued progress in upholding human rights and promoting inclusivity.

SUHAKAM Gesa Kerajaan Menilai Secara Positif Semua Cadangan yang Diterima di UPR Keempat Malaysia

KUALA LUMPUR (26 JANUARI 2024) Suruhanjaya Hak Asasi Manusia Malaysia (SUHAKAM) telah menjadi pemerhati Penilaian Berkala Sejagat (UPR) Malaysia ke-4 pada sesi ke-45 kumpulan kerja UPR di Geneva, Switzerland pada 25 Januari 2024. Pelbagai isu hak asasi manusia telah diketengahkan dan disyorkan kepada Malaysia.

Semasa sesi UPR dijalankan, negara-negara anggota Pertubuhan Bangsa -bangsa Bersatu (PBB) mengiktiraf dan menyambut baik reformasi undang-undang dan institusi yang dilaksanakan oleh kerajaan, termasuk peningkatan perlindungan hak untuk wanita, kanak-kanak dan kumpulan rentan lain termasuk pengukuhan pembaharuan perundangan melalui perlindungan undang-undang tambahan. Majoriti negara anggota PBB memuji usaha Malaysia memansuhkan hukuman mati mandatori, yang telah berkuat kuasa pada 4 Julai 2023. Selain itu, usaha kerajaan memperkasa SUHAKAM sebagai Institusi Hak Asasi Manusia Kebangsaan dengan pengukuhan yang diperlukan untuk mempromosikan dan melindungi hak asasi manusia di Malaysia turut dipuji.

Antara cadangan utama lain adalah termasuk memansuhkan sepenuhnya hukuman mati; meningkatkan umur minimum perkahwinan kepada 18 tahun; meningkatkan hak, perlindungan, dan penambahbaikan kesejahteraan warga emas dan orang kurang upaya,  memansuhkan hukuman rotan di sekolah; memerangi isu pemerdagangan manusia; membangunkan rangka kerja untuk melindungi pelarian, orang tanpa dokumen dan tanpa kewarganegaraan; mengukuhkan perlindungan sosial bagi kumpulan rentan terutama di kawasan luar bandar; memberikan  kewarganegaraan kepada anak-anak yang dilahirkan di luar negara oleh ibu warganegara Malaysia; mengkaji semula baki perjanjian hak asasi manusia antarabangsa utama dan menarik balik reservasi kepada Konvensyen yang telah diratifikasi.

UPR ke-4 Malaysia yang dikendalikan oleh Argentina, Eritrea, dan Vietnam yang berperanan sebagai ‘troika’ telah menyaksikan semakan dan cadangan daripada 130 Negara Anggota PBB. SUHAKAM berpendapat bahawa peningkatan kadar penyertaan berbanding dengan 111 Negara Anggota PBB dalam UPR ke-3 Malaysia pada tahun 2018 menunjukkan bahawa tumpuan diberikan kepada situasi hak asasi manusia di Malaysia pada kali ini.

Di peringkat nasional, SUHAKAM telah mengadakan satu forum hibrid di Fakulti Undang-Undang, Universiti Malaya diikuti dengan penstriman langsung  sesi yang diadakan di Geneva. Forum yang dikendalikan oleh SUHAKAM ini menampilkan wakil dari Pusat KOMAS (KOMAS), Pergerakan Belia Islam Malaysia (ABIM), dan Pejabat Pesuruhjaya Tinggi Hak Asasi Manusia (OHCHR) Asia Tenggara. Objektif forum ini adalah untuk meningkatkan kesedaran mengenai proses UPR dan merupakan platform untuk membincangkan isu-isu hak asasi manusia yang semakin meruncing. SUHAKAM mengucapkan terima kasih kepada semua peserta atas penyertaan mereka dan pandangan yang diberikan semasa sesi tersebut dijalankan.

Sebagai pemerhati kepada 3 kitaran UPR Malaysia yang terdahulu, SUHAKAM mengakui akan impak positif proses penilaian ini. SUHAKAM menyeru Kerajaan untuk mengkaji secara positif kesemua cadangan yang diterima dan memenuhi komitmennya untuk mencapai objektif UPR melalui pendekatan yang menyeluruh kepada masyarakat. SUHAKAM menantikan penerimagunaan laporan hasil pada 31 Januari 2024, yang akan menjadi halatuju Malaysia untuk terus  memajukan hak asasi manusia dan mempromosikan keterangkuman.

A Year of Paradoxes: Human Rights Triumphs and Challenges in 2023

The year 2023, marking the 75th anniversary of the Universal Declaration of Human Rights, was a paradoxical period in human rights history. This pivotal year celebrated the strides made since the Declaration’s inception while also confronting the harsh realities of ongoing human rights crises across the globe.

Global Human Rights Challenges

Despite this milestone, we witnessed grave violations of human rights that shook the global community.  We condemn the attack and taking of hostages and killing of Israeli civilians on 7 October 2023 but the disproportionate attack and killings of more than 20000 civilians and the annihilation of Gaza by the full might of the Israeli army with full support from the United States is genocide.

The role of external powers, especially the United States, in the Gaza conflict has underscores the complex geopolitical dynamics and hypocrisy on international human rights and its universality. The United States unconditional support for Israel with a caveat that “killing of civilians in Gaza should be in a gentle and kinder manner” or “civilian deaths should be minimised” is shocking untenable and so obviously skewered that Palestinian lives matter much less than Israeli ones.

This stance, coupled with the United States’ complicity in providing military aid and support, exposed a harsh truth: even powerful states blatantly condone or escalate human right abuses whenever convenient or suitable for their political purpose.

SUHAKAM continues to fully support and endorse the Government’s initiative in advocating for international action against Israel. SUHAKAM shall rally support from National Human Rights Institutions (NHRIs) globally, at both regional and international forums, and through any other feasible actions necessary to promote this objective.

This commitment underlines the importance of collaborative efforts and international solidarity in addressing and resolving human rights violations on a global scale.

Human Rights Progress in Malaysia

We welcome the Government’s efforts to address human rights issues domestically, such as significant legislative reforms which includes the repeal, amendment, and enactment of various laws. Notably, the Government abolished the mandatory death penalty, expanded the scope and ambit of Sexual Offences Against Children Act 2017, and proceeded to decriminalise suicide.

Additionally, the introduction of an anti-stalking provision under Section 507A of the Penal Code and the emphasis on mental health protection are examples of meaningful progress made in 2023.

The Federal Court has also been proactive through judicial activism in the strengthening of rights pursuant to the Federal Constitution in striking out ruling that Section 498 of the Penal Code which stated that enticing married women was unconstitutional as it violated the principle of equality.

Numerous decisions of the Courts in upholding citizenship rights of children that had long been neglected and ignored by the Government, have now been restored their citizenship as provided for under the Federal Constitution. We urge the Government to steadfastly proceed with institutional reforms especially in respect of citizenship provisions to ensure that our children would not be “punished” under the guise of national security.

The restructuring and separation of the role of the Public Prosecutor is ongoing and reforms to all the major enforcement agencies including the prisons must be carried out to enhance accountability and transparency.

The Government must ensure that there will be strict adherence to the rule of law and proceed to amend or repeal various provisions the Security Offences (Special Measures) Act 2012 (SOSMA) and The Prevention of Crime Act 1959 (POCA) to ensure that rights of accused persons are protected to the full extent of the law.         

Institutional Reforms and Ambitious Goals

The amendments to SUHAKAM Act were a significant stride towards ensuring that SUHAKAM’s operation will be carried out independently and with integrity. This amendment underscores the Government’s dedication to human rights and reflects a commitment to inclusive and diverse representation such as gender balance and the inclusion of persons with disabilities in the Commission. Through the amendment, SUHAKAM aims to better safeguard and promote human rights within Malaysia, ensuring that all societal groups are adequately represented, and their rights are duly protected. Furthermore, the Bill also aims to strengthen the Children Commissioner’s role by institutionalizing and expanding the Office of Children’s Commissioner (OCC) within SUHAKAM.

As a National Human Rights Institution (NHRI) in Malaysia, it is important to maintaining a team of Commissioners who are not only knowledgeable but also deeply committed their work towards the protection and promotion of the rights of marginalised communities and vulnerable groups such as children, women, and persons with disabilities.

The Road Ahead for SUHAKAM

Looking ahead to 2024, SUHAKAM continues to focus on laying the groundwork for Malaysia’s accession to the International Convention for the Protection of All Persons from Enforced Disappearance (ICCPED), the United Nations Convention Against Torture (UNCAT), and the 1951 Refugee Convention. Our goal for 2024 includes intensifying our efforts to address poverty among teenage girls and preparing white papers on climate change, prison reform, and refugees. We acknowledge the importance of community engagement in highlighting human rights awareness, and hence we will continue our work with communities and monitoring of all detention places.

At the international level, SUHAKAM, in collaboration with fellow Southeast Asian National Human Rights Institutions, will move forward with initiative to establish a public inquiry panel which has been designed to tackle cross-border human rights challenges effectively within the region.

SUHAKAM pledged to remain steadfast in our commitment to address the issues faced by all vulnerable groups.  We are also looking forward to delving into and exploring emerging issues, such as the interplay between digital rights, technology, and their impact on human rights.

Despite the complexities and challenges encountered in 2023, SUHAKAM would like to extend our greatest gratitude for the unwavering support to all of our stakeholders. Their commitment in creating a safer environment for human rights protection, both in Malaysia and abroad, remains, offering a beacon of hope as we grapple with intricate human rights issues in Malaysia and also worldwide. As we move into 2024 and beyond, SUHAKAM’s resolve to stand firm in the pursuit of a more just and equitable world underscores their dedication to protecting and upholding human rights for all.

Press Statement No.1-2024_SUHAKAM Commited to Support South Africa in ICJ Case Against Israel, Urges Malaysian Intervention

KUALA LUMPUR (15 JANUARY 2024) — SUHAKAM welcomes the Government’s support for South Africa’s legal action against Israel at the International Court of Justice (ICJ), which is the principal judicial organ of the United Nations.

We urge the Government to intervene in the deliberations at the ICJ. Malaysia, a state party to the Genocide Convention, must commit and ensure that Israel is held accountable for the current atrocities in Gaza and for the decades of abuse violations and dehumanising of the Palestinians. We also call for the Government to review its reservation to Article 9 of the Genocide Convention, particularly focusing on the prevention and punishment of the crime.

The Government must reach out to all our allies within the Association of Southeast Asian Nations (ASEAN) and other regional bodies to intervene or support the right of Palestinians to statehood and all it entails. We note that South Africa is being supported by around 20 countries and opposed by among others, the United States, United Kingdom, Germany and Canada.

In line with our commitment to foster solidarity among national human rights institutions, SUHAKAM commits to support the South African Human Rights Commission.  SUHAKAM calls upon the international community to lend their support to South Africa’s case, highlighting the importance of ensuring justice, human rights, and accountability. SUHAKAM hopes the case will eventually find a peaceful resolution to the conflicts in the region.

SUHAKAM Komited Menyokong Afrika Selatan Heret Israel ke ICJ, Gesa Campur Tangan Malaysia

KUALA LUMPUR (15 JANUARI 2024) Suruhanjaya Hak Asasi Manusia Malaysia (SUHAKAM) menyambut baik sokongan Kerajaan Malaysia kepada Afrika Selatan yang telah mengheret Israel di Mahkamah Keadilan Antarabangsa (ICJ), yang merupakan suatu badan kehakiman utama Pertubuhan Bangsa-Bangsa Bersatu.

SUHAKAM menggesa kerajaan untuk turut campur tangan dalam perbincangan di ICJ. Sebagai negara pihak kepada Konvensyen Genosid, Malaysia harus memberi komitmen dan memastikan Israel bertanggungjawab ke atas kekejaman di Gaza dan pelanggaran hak asasi manusia dan penyeksaan yang tidak berperikemanusiaan terhadap rakyat Palestin sejak berdekad lamanya. SUHAKAM juga menyeru agar Kerajaan menimbang semula reservasi kepada Perkara 9 Konvensyen Genosid yang khususnya menekankan mengenai pencegahan dan hukuman jenayah.

Kerajaan perlu bersepakat dengan semua sekutu dalam Pertubuhan Negara-negara Asia Tenggara (ASEAN) dan badan-badan serantau lain untuk turut campur tangan atau menyokong hak rakyat Palestin dalam mendapatkan kedaulatan negara mereka. Afrika Selatan kini mendapat sokongan kira-kira 20 buah negara dan antara negara yang memberikan tentangan adalah Amerika Syarikat, United Kingdom, Jerman dan Kanada.

Selaras dengan komitmen untuk memupuk solidariti dalam kalangan institusi hak asasi manusia kebangsaan, SUHAKAM dengan ini komited menyokong Suruhanjaya Hak Asasi Manusia Afrika Selatan. SUHAKAM menyeru masyarakat antarabangsa untuk terus memberi sokongan kepada Afrika Selatan dan menggariskan akan kepentingan untuk memastikan keadilan, hak asasi manusia, dan kebertanggungjawaban. SUHAKAM berharap agar isu ini akan menemui satu titik penyelesaian damai kepada konflik di rantau tersebut.

Press Statement No. 49-2023_SUHAKAM Urges Immediate Action on Migrant Workers in Malaysia

KUALA LUMPUR (29 DECEMBER 2023) — The Human Rights Commission of Malaysia (SUHAKAM) is deeply concerned with the recent report of the detention of 171 Bangladesh workers exploited and trafficked into Malaysia with the false promise of jobs despite paying huge recruitment fees. Prior to their arrest, it was reported that they were marching to the Bayu Damai police station in Johor, to lodge reports that they were cheated by agents promising jobs. Their desperation must have driven them to lodge reports despite being aware of the risk of arrest, detention and deportation.

SUHAKAM is of the view that these victims were in such a dire situation and reaching out to the police must have been a last resort attempt to return to their country of origin despite huge personal suffering and massive financial losses. These people were duped and entered Malaysia on a valid immigration pass indicating the strong possibility of lax enforcement approvals and very likely corrupt practices within the relevant agencies.

SUHAKAM has in the past, issued numerous statements on modern slavery and human trafficking in the guise of “legalised” recruitment processes which are manifestly inhumane, abusive and exploitative to migrants. SUHAKAM’s position on migrant workers issues has always been rooted in the principles of justice, including educating the public and industries on the accountability in business practices and respect for human rights.

Therefore, we implore and urge the Government to seriously address this matter and execute the following actions:

i. Setting up a high-level task force to facilitate thorough and transparent investigations, identify short comings and most importantly action to be recommended against person(s) involved in this horrible and exploitative human trafficking processes;

ii.  Expedite the implementation of the recommendations listed in the “Report of the Independent Committee on the Management of Foreign Workers” which include issues of unethical, unhealthy, and unfair practices in the recruitment of foreign workers. The foreign workers monitoring systems should also be amplified to ensure fair and safe working conditions for migrant workers, along with cooperation with countries of origin to create safe migration routes;

iii. Working towards a complete overhaul in terms of policies, processes, accountability and transparency in the recruitment and management of migrant workers and proceed to set up a dedicated Ministry to manage all migrant workers’ affairs in the country.

SUHAKAM calls upon all relevant agencies to immediately address the longstanding issues of foreign workers management in Malaysia. We have to be mindful that these issues involve basic and inviolable human rights, and the lack of meaningful action and continued indifference will only reflect on us as a nation and society lacking in compassion dignity and humane values.

SUHAKAM Desak Segera Tangani Isu Pekerja Asing di Malaysia

KUALA LUMPUR (29 DISEMBER 2023) — Suruhanjaya Hak Asasi Manusia Malaysia (SUHAKAM) bimbang dengan laporan mengenai penahanan 171 pekerja Bangladesh yang dieksploitasi dan diperdagangkan ke Malaysia dengan janji pekerjaan palsu walaupun telah membayar yuran pengambilan kerja yang tinggi. Sebelum itu, mereka telah berjalan ke balai polis Bayu Damai, Johor untuk membuat laporan bahawa mereka telah diperdaya oleh ejen yang menjanjikan peluang pekerjaan. Situasi yang mendesak telah mendorong mereka untuk membuat laporan walaupun menyedari akan risiko penahanan, penangkapan dan dihantar pulang.

SUHAKAM berpendapat bahawa mangsa-mangsa ini terdesak sehingga mereka terpaksa melaporkan perkara ini kepada pihak polis  sebagai usaha terakhir untuk kembali ke negara asal meskipun mengalami penderitaan dan kerugian kewangan yang besar. Mereka telah diperdaya dan masuk ke Malaysia dengan pas imigresen yang sah dan ini menunjukkan kemungkinan penguatkuasaan yang lemah dan amalan rasuah dalam agensi-agensi yang berkaitan.

SUHAKAM telah mengeluarkan banyak kenyataan mengenai perhambaan moden dan pemerdagangan manusia bertopengkan proses pengambilan secara “sah” tetapi jelas tidak berperikemanusiaan, menyalahguna dan mengeksploitasi migran. Pendirian SUHAKAM mengenai isu pekerja migran sentiasa berpaksikan kepada prinsip keadilan, termasuk pendidikan kepada orang ramai dan industri tentang akauntabiliti dalam amalan perniagaan dan penghormatan kepada hak asasi manusia.

Oleh itu, SUHAKAM menyeru dan menggesa Kerajaan untuk menangani perkara ini dengan serius dan melaksanakan tindakan berikut:

  1. Menubuhkan pasukan petugas khas untuk membantu penyiasatan yang menyeluruh dan telus, mengenal pasti kelemahan dan yang paling utama, syor-syor tindakan yang perlu diambil terhadap pihak yang terlibat dalam proses pemerdagangan manusia yang tidak berperikemanusiaan ini;
  2. Mempercepatkan pelaksanaan syor-syor dalam “Laporan Jawatankuasa Bebas Pengurusan Pekerja Asing” yang merangkumi isu-isu amalan tidak beretika, tidak sihat, dan tidak adil dalam pengambilan pekerja asing. Sistem pemantauan pekerja asing juga harus dipertingkatkan untuk memastikan persekitaran kerja yang adil dan selamat untuk pekerja migran, berkerjasama dengan negara asal untuk mewujudkan laluan penghijrahan yang selamat;
  3. Berusaha ke arah pembaharuan yang menyeluruh dari segi dasar, proses, akauntabiliti dan ketelusan dalam pengambilan dan pengurusan pekerja migran dan menubuhkan satu Kementerian yang khusus bagi pengurusan hal ehwal pekerja asing di negara ini.

SUHAKAM menyeru agensi yang berkaitan untuk segera menangani isu pengurusan pekerja asing yang telah lama berlarutan di Malaysia. Isu-isu pencabulan hak asasi manusia dan kurangnya tindakan yang kukuh serta sikap tidak acuh yang berterusan hanya akan mencerminkan Malaysia sebagai negara  yang tidak mempunyai belas kasihan terhadap maruah dan nilai-nilai kemanusiaan.

Press Statement No. 48-2023_SUHAKAM Calls for Concrete Collaborative Efforts on Children’s Educational Rights in Omadal Island

KUALA LUMPUR (28 DECEMBER 2023) – In response to the objections to the establishment of Iskul Sama DiLaut Omadal, an alternative learning center on Omadal Island, Sabah, the Human Rights Commission of Malaysia (SUHAKAM) wishes to reaffirm its commitment to the fundamental right to education for all and its role in humanizing and developing individuals.

SUHAKAM, alongside the Indonesia National Commission on Human Rights (Komnas HAM) and the Commission on Human Rights of the Philippines (CHRP), aligned with the tripartite MoU on Statelessness in Sabah had visited the center on 8th September 2023. During this engagement, SUHAKAM has observed firsthand, the significant impact of Iskul’s efforts in providing literacy training to the stateless children. Recognizing the vital role Iskul plays in addressing educational gaps for these stateless children, SUHAKAM Sabah Office convened a meeting in November this year to explore avenues of support for Iskul’s continued operations and their application to be registered as an alternative guidance centre (PBA).

While SUHAKAM commends the establishment of Sekolah Bimbingan Jalinan Kasih (SBJK) which aims at providing access to equal education for all young people, including dropouts, street kids and undocumented children in Sabah, we hope Iskul will be allowed to continue its operations and in addition to this, we also hope the existing SBJK will be provided with proper facilities to ensure the children will receive quality and equitable inclusive education.

In furtherance of the above and the Government’s commitment to the 2030 Agenda for Sustainable Development that no child is left behind in the pursuit of quality education, SUHAKAM therefore calls for more concrete collaborative efforts between the Ministry of Education, local community leaders, Non-Governmental Organisations, and other relevant stakeholders to address the educational needs of Omadal Island’s children, regardless of their background. SUHAKAM firmly believes that providing safe space for children to access education will eventually promote lifelong learning opportunities and underscores the importance of due diligence and non-discrimination on access to education for all children in Malaysia. SUHAKAM stands ready to cooperate and assist the Government to address this matter.

SUHAKAM Seru Kerjasama Kukuh Tangani Isu Hak Pendidikan Kanak-kanak di Pulau Omadal

KUALA LUMPUR (28 DISEMBER 2023) – Susulan bantahan terhadap penubuhan Iskul Sama DiLaut Omadal, sebuah pusat pembelajaran alternatif di Pulau Omadal, Sabah, Suruhanjaya Hak Asasi Manusia Malaysia (SUHAKAM) teguh menegaskan komitmen terhadap hak pendidikan untuk semua kerana ia adalah asas kemanusiaan dan perkembangan setiap individu.

Sejajar dengan pembaharuan MoU tiga pihak mengenai Isu Tanpa Kewarganegaraan di Sabah, SUHAKAM, bersama Komisi Nasional Hak Asasi Manusia Indonesia (Komnas HAM), dan Suruhanjaya Hak Asasi Manusia Filipina (CHRP) telah melawat pusat itu pada 8 September 2023. SUHAKAM telah membuat pemerhatian secara langsung kepentingan usaha Iskul dalam memberikan pendidikan asas kanak-kanak tanpa kewarganegaraan. Menyedari peranan penting Iskul dalam menangani jurang pendidikan, pejabat SUHAKAM Sabah telah mengadakan mesyuarat pada bulan November untuk meneroka langkah sokongan agar Iskul dapat terus beroperasi dan permohonan mereka untuk didaftarkan sebagai pusat bimbingan alternatif (PBA) dapat diluluskan.

SUHAKAM memuji penubuhan sekolah Bimbingan Jalinan Kasih (SBJK) yang bertujuan untuk menyediakan akses kepada pendidikan yang sama rata untuk semua golongan muda, termasuk kanak-kanak yang tercicir, kanak-kanak jalanan dan kanak-kanak tanpa dokumen di Sabah. Oleh itu, kami berharap Iskul juga akan dibenarkan untuk meneruskan operasinya dan SBJK yang sedia ada dapat diperuntukkan dengan kemudahan yang bersesuaian agar kanak-kanak mendapat akses kepada pendidikan inklusif yang berkualiti dan saksama.

Lanjutan daripada perkara di atas serta komitmen kerajaan terhadap Agenda Matlamat Pembangunan Mampan 2030 agar tiada kanak-kanak yang ketinggalan dalam mendapatkan pendidikan berkualiti, SUHAKAM dengan ini menyeru agar kerjasama dapat diperkukuh antara Kementerian Pendidikan Malaysia, pemimpin masyarakat tempatan, pertubuhan bukan kerajaan dan pihak berkepentingan yang berkaitan dalam menangani keperluan pendidikan kanak-kanak Pulau Omadal, tanpa mengira latar belakang mereka. SUHAKAM yakin bahawa ruang yang selamat untuk kanak-kanak mendapat akses pendidikan akan menggalakkan peluang pembelajaran sepanjang hayat. Usaha ke arah tiada diskriminasi terhadap akses kepada pendidikan adalah penting untuk semua kanak-kanak di Malaysia dan SUHAKAM sentiasa bersedia untuk bekerjasama dan membantu kerajaan untuk menangani perkara ini.

Press Statement No. 47-2023_ SUHAKAM Expresses Grave Concerns Over Proposed Citizenship Amendments in Malaysia

KUALA LUMPUR (18 DECEMBER 2023) – The Human Rights Commission of Malaysia (SUHAKAM) has serious concerns on the Government’s proposal to amend several citizenship provisions under Part II of the Second Schedule of the Federal Constitution purportedly to prevent the misuse of acquiring Malaysian citizenship. We have to date not been provided with any data or information of such abuse or misuse in the applications.

SUHAKAM is of the view that amendments to the Federal Constitution must be premised on a humane approach to enhance clarify and streamline the process of citizenship applications. We wish to emphasize that the proposed amendments, particularly the proposal to abrogate Sections 1(e) and 2(3) in Part II of the Second Schedule, could adversely affect vulnerable groups like children born out of wedlock, stateless children adopted by Malaysian parents, and foundlings. These changes risk deepening the challenges faced by generational stateless individuals in Malaysia.

These proposed amendments would then create generational issues of statelessness further burdening the State with such people unable to fend for themselves and unable to be productive and contribute to the nation.

Moving forward, SUHAKAM urges the Government to adopt a holistic and considerate approach in addressing these citizenship issues. This includes conducting thorough research on the potential impacts of these amendments and engaging in a comprehensive consultation process with a diverse range of stakeholders, including civil society organizations and experts in children’s rights and statelessness. It’s crucial that each amendment be carefully considered for its unique implications to ensure that the fundamental rights of all individuals, particularly children, are upheld.

Nationality is fundamental to human rights, particularly for children, as it lays the foundation for accessing other vital basic rights such as education and healthcare. Guaranteeing each child has a nationality extends beyond providing legal identity; it safeguards their future and empowers them to contribute fully to society. It is crucial that the proposed citizenship amendments undergo thorough examination and revision to ensure alignment with human rights values reflecting the Government’s commitment to principles of justice and equality. This approach will ultimately enable every child in Malaysia to experience a healthy, educated, and fulfilled life.

SUHAKAM Menzahirkan Kebimbangan Terhadap Usul Pindaan Kewarganegaraan di Malaysia

KUALA LUMPUR (18 DISEMBER 2023) – Suruhanjaya Hak Asasi Manusia Malaysia (SUHAKAM) menzahirkan kebimbangan dengan cadangan Kerajaan untuk meminda beberapa peruntukan mengenai kewarganegaraan di bawah Bahagian II Jadual Kedua Perlembagaan Persekutuan yang dikatakan bertujuan mencegah penyalahgunaan permohonan kewarganegaraan Malaysia. Sehingga kini, SUHAKAM masih tidak diberikan sebarang data atau maklumat mengenai penyalahgunaan atau penyelewangan permohonan tersebut. 

SUHAKAM berpendapat bahawa pindaan kepada Perlembagaan Persekutuan perlu berlandaskan pendekatan yang berperikemanusiaan untuk kejelasan dan penyelarasan proses permohonan yang lebih baik. SUHAKAM ingin menekankan bahawa pindaan yang dicadangkan, khususnya cadangan untuk membatalkan Seksyen 1(e) dan 2(3) dalam Bahagian II Jadual Kedua, boleh memberi impak negatif kepada kumpulan rentan seperti anak tidak sah taraf, anak tanpa kewarganegaraan yang diambil sebagai anak angkat oleh pasangan warganegara Malaysia dan, kanak-kanak yang dijumpai/terabai. Perubahan ini memberi cabaran yang lebih sukar kepada individu tanpa kewarganegaraan dari satu generasi ke satu generasi di Malaysia.

Pindaan yang dicadangkan ini akan mewujudkan isu tanpa kewarganegaraan yang berpanjangan dan semakin membebankan kerana mereka tidak dapat berdikari, produktif serta menyumbang kepada negara.

Dalam melangkah ke hadapan, SUHAKAM menggesa Kerajaan untuk mengambil pendekatan holistik dan bertimbang rasa dalam menangani isu-isu kewarganegaraan sebegini. Ini termasuk menjalankan penyelidikan menyeluruh mengenai impak pindaan ini dan mengadakan proses perundingan yang komprehensif dengan pelbagai pihak berkepentingan termasuk organisasi masyarakat sivil dan pakar dalam bidang hak kanak-kanak dan tanpa kewarganegaraan. Adalah penting untuk memastikan setiap satu pindaan dipertimbangkan dengan teliti dengan mengambil kira implikasinya yang unik bagi memastikan hak asasi setiap individu, terutamanya kanak-kanak dapat dilindungi.

Kewarganegaraan adalah asas kepada hak asasi manusia, terutamanya bagi kanak-kanak, kerana ia merupakan asas kepada akses hak asasi yang penting seperti pendidikan dan penjagaan kesihatan. Memastikan setiap kanak-kanak memiliki kewarganegaraan bukan sekadar memberikan identiti dari segi undang-undang; ia juga untuk melindungi masa depan dan membolehkan mereka untuk menyumbang sepenuhnya dalam masyarakat. Pindaan kewarganegaraan yang dicadangkan ini perlu disemak secara menyeluruh, selaras dengan nilai-nilai hak asasi manusia yang mencerminkan komitmen Kerajaan terhadap prinsip keadilan dan kesaksamaan. Pendekatan ini akan membolehkan setiap kanak-kanak untuk menikmati kehidupan yang sihat, berilmu dan lebih bermakna.

Joint Press Statement_SUHAKAM and ADSP Ready to Support Government Initiatives for an Inclusive Education of Children in Malaysia

KUALA LUMPUR (9 DECEMBER 2023) – The Office of the Children’s Commissioner of the Human Rights Commission of Malaysia (SUHAKAM) has jointly hosted a launch on the “Policy Brief on the right to Education of the Refugee and Stateless Children” with our partner, United Nations High Commissioner for Refugees (UNHCR) and Asia Displacement Solutions Platform (ADSP), supported by the European Union Civil Protection Humanitarian Aid (ECHO).

The policy brief is a product of the Roundtable Table Discussion held on 10 May 2023 that gathered the diverse opinion and comment of public stakeholders. It seeks to explore the gaps and challenges currently faced by refugee and stateless children in receiving education in Malaysia. It also presents a menu of recommendatory and alternative resolutions to the government in providing a more secure and enhanced quality of education to children from different walks of life.

OCC would like to extend our gratitude to the Minister of Education, YB Puan Fadhlina Sidek for her congratulatory message to the launch. We welcome her message and MADANI Government’s effort and commitment to realise the right to receive education of all children in Malaysia with a multi-pronged approach.

However, among the plethora of recommendations and in light of the current socioeconomic development, SUHAKAM and ADSP urge the government as below:

1. to progressively recognize the Alternative Learning Centre (ALC) and Community Learning Centre (CLC) in Malaysia as the preliminary means of increasing the access of refugee and stateless children of non-Malaysian parents;

2. to loosen the requirement and expedite the enrolment of stateless children of Malaysian parents in the public school through the issuance of temporary document;

3. to work towards ensuring all children have equal access to free and compulsory education regardless of citizenship as a long-term solution.

Malaysia still falls short of adopting a full conceptualization of children’s rights in the public education system without fulfilling the basic access to education to all children. A child-centric and systemic education services could mend the social safety net that captures any child fall through the cracks.

Encouragingly, education can serve as an accessible line of protection from any harmful practices or childhood-depriving situations such as child labour and child marriage. It consequentially diminishes the prevalence of child poverty and child malnutrition, relieving the overstretched child protection services provided. Thus, creating a sustainable solution that enhances the children ecosystem in Malaysia.

Indeed, the absence of education diminishes the prospects of qualifying for resettlement and hinders socio-economic integration. Additionally, for families contemplating safe, dignified and voluntary repatriation, guaranteeing uninterrupted education for their children is imperative. This not only fosters individual growth but also contributes to the broader goal of sustainably rebuilding communities upon return to their country of origin.

SUHAKAM and ADSP stand ready to assist and advise government further in creating an enabling and inclusive environment for all children to receive not only education but also of the highest standard. Despite our respective democratic functions, the complementarity nature found within the public and private stakeholders requires a joint effort which allows us to urgently respond to the non-negotiable standard of care to every child in Malaysia.

SUHAKAM dan ADSP Bersedia Untuk Menyokong Inisiatif Kerajaan untuk Pendidikan Inklusif Kanak-kanak di Malaysia

KUALA LUMPUR (9 DISEMBER 2023) – Pejabat Pesuruhjaya Kanak-Kanak, Suruhanjaya Hak Asasi Manusia Malaysia (SUHAKAM) telah menganjurkan pelancaran ringkasan dasar mengenai hak pendidikan kanak-kanak pelarian dan tanpa kewarganegaraan dengan penganjur bersama, Pesuruhjaya Tinggi Pertubuhan Bangsa-Bangsa Bersatu bagi Pelarian (UNHCR) serta Asia Displacement Solutions Platform (ADSP) dengan sokongan daripada European Union Civil Protection Humanitarian Aid (ECHO).

Ringkasan dasar ini adalah hasil daripada Perbincangan Meja Bulat bertarikh 10 Mei 2023 yang mengumpulkan pelbagai pandangan serta ulasan daripada pemegang taruh dan orang awam. Selain itu, ia turut menyelusuri jurang dan cabaran yang kini dihadapi oleh kanak-kanak pelarian dan tanpa kewarganegaraan untuk mendapatkan akses kepada pendidikan di Malaysia. Ia juga turut membentangkan senarai syor dan penyelesaian alternatif kepada Kerajaan dalam memberikan pendidikan yang lebih selamat dan berkualiti kepada kanak-kanak daripada pelbagai latar belakang.  

OCC menzahirkan penghargaan kepada Menteri Pendidikan, YB Puan Fadhlina Sidek atas kesudian beliau menyampaikan mesej dan ucapan tahniah dalam majlis pelancaran tersebut. Kami menyambut baik mesej beliau dan usaha kerajaan MADANI serta komitmen dalam merealisasikan hak untuk mendapatkan pendidikan melalui pelbagai pendekatan kepada semua kanak-kanak di Malaysia.  

Mengambil kira perkembangan sosioekonomi pada masa kini, SUHAKAM dan ADSP dengan ini menggesa Kerajaan untuk mempertimbangkan syor seperti berikut:

1.            Mengiktiraf Pusat Pembelajaran Alternatif (ALC) dan Pusat Pembelajaran Komuniti (CLC) di Malaysia sebagai laluan awal untuk meningkatkan akses pendidikan kanak-kanak pelarian dan tanpa kewarganegaraan yang lahir dalam kalangan ibu bapa bukan warganegara Malaysia;

2.            Melonggarkan syarat dan mempercepatkan pendaftaran kanak-kanak tanpa kewarganegaraan daripada ibu bapa warganegara Malaysia di sekolah awam melalui pengeluaran dokumen sementara;

3.            Usaha untuk memastikan semua kanak-kanak menerima akses yang saksama kepada pendidikan percuma dan wajib tanpa mengira kewarganegaraan, sebagai satu penyelesaian jangka panjang.  

Malaysia masih lagi ketinggalan dalam mengguna pakai konsep hak kanak-kanak dalam sistem pendidikan awam yang turut merangkumi akses kepada pendidikan asas. Perkhidmatan yang sistemik dan berpaksikan kepada kanak-kanak boleh memperbaiki jaringan keselamatan sosial yang dapat menyelamatkan kanak-kanak daripada terperangkap dalam jurang yang sedia ada.  

Pendidikan berfungsi sebagai perlindungan yang boleh diakses oleh kanak-kanak bagi mengelakkan mereka daripada menjadi mangsa situasi yang tidak diingini seperti buruh kanak-kanak dan perkahwinan bawah umur. Ia juga boleh merendahkan kadar kemiskinan dan kekurangan zat makanan dalam kalangan kanak-kanak serta mengurangkan tekanan kepada penyedia perkhidmatan perlindungan kanak-kanak. Ini sekaligus dapat menjadi penyelesaian yang mampan dan meningkatkan eksosistem kanak-kanak di Malaysia. 

Ketiadaan pendidikan mengurangkan peluang kelayakan kanak-kanak dalam proses penempatan semula dan menghalang integrasi sosio-ekonomi merekan. Pendidikan amat penting bagi keluarga yang sedang mempertimbangkan repatriasi secara selamat, bermaruah dan sukarela. Ini bukan sahaja memupuk pertumbuhan sahsiah kanak-kanak tetapi juga menyumbang kepada matlamat yang lebih meluas dalam pembangunan semula komuniti apabila mereka kembali ke negara asal. 

SUHAKAM dan ADSP bersedia untuk membantu dan menasihati Kerajaan dalam usaha untuk mewujudkan suasana yang inklusif dan berdaya maju agar semua kanak-kanak dapat menerima pendidikan yang berkualiti tinggi. Meskipun mempunyai fungsi demokrasi tersendiri, ciri saling melengkapi antara pemegang taruh awam dan swasta memerlukan usahasama yang membolehkan kita untuk segera mengambil tindakan bagi memelihara piawaian penjagaan semua kanak-kanak di Malaysia.

Press Statement No. 46-2023_SUHAKAM Calls for Combating Against Racial Discrimination in 22nd OIC-IPHRC Session

JEDDAH, KINGDOM OF SAUDI ARABIA (30 NOVEMBER 2023) – The Human Rights Commission of Malaysia (SUHAKAM) participated in the 22nd Regular Session of the Independent Permanent Human Rights Commission (IPHRC) of the Organization of Islamic Cooperation (OIC) held in Jeddah, Kingdom of Saudi Arabia from 26-30 November 2023. The session was attended by various stakeholders including IPHRC members, experts from international organizations, representatives of OIC Member and Observer States including their respective National Human Rights Institutions (NHRIs).

A thematic debate on ‘Elimination of Racial Discrimination: An Islamic and Human Rights Perspective’ was jointly organized by OIC-IPHRC in collaboration with the Saudi Human Rights Commission (SHRC) during the Session to discuss on measures to be taken to address the growing scourge of discrimination, including racial discrimination and its various contemporary manifestations. SUHAKAM, represented by Commissioner Puan Nazira Abdul Rahim delivered an intervention statement.

“Racism, racial discrimination and xenophobia have no place in any society and the failure to tackle this issue may lead to a more violent situation as is currently happening in Palestine. Implied acceptance and condonation of powerful Nations to the practice of apartheid, illegal occupation, denial of basic human needs and collective punishment against Palestinian civilians, half of them children, is condemned by SUHAKAM. Indeed, the violence that has led to the loss of life, annihilation of whole families would only cause despair and trauma that will last forever. The acts of terror, the killings, destroying public infrastructure including health facilities inside Gaza, residential buildings and places of worship are serious violations of the laws and customs applicable in international armed conflict, within the established framework of international law”.

The key recommendations of the debate will be finalized by the SHRC and to be consolidated into an outcome document to encourage dialogue and sharing of best practices in combating racial discrimination. It is crucial to foster a culture of tolerance, equality and non-discrimination towards developing a just, peaceful and sustainable society in the future and in achieving this, the enactment of relevant laws that focus on improving, safeguarding and encouraging beneficial race/ethnic relations should be in place. The execution of these laws should be effectively monitored in order to promote national harmony, unity, reconciliation, integration and non-discrimination in the society. In view of this and the launch of the National Unity Action Plan 2021-2030 in 2021, SUHAKAM calls for the Government to re-visit the decision to discontinue the National Harmony and Reconciliation Commission Bill.

In embracing the spirit of Article 8 of the Federal Constitution as the cornerstone of constitutional protection of equality and non-discrimination, SUHAKAM calls for all parties to be at the forefront in combating racism, racial discrimination and xenophobia in Malaysia. SUHAKAM Seru Memerangi Diskriminasi Kaum dalam Sesi Mesyuarat IPHRC-OIC Ke-22

JEDDAH, KERAJAAN ARAB SAUDI (30 NOVEMBER 2023) – Suruhanjaya Hak Asasi Manusia Malaysia (SUHAKAM) telah mengambil bahagian dalam Mesyuarat Ke-22 Suruhanjaya Bebas Tetap Hak Asasi Manusia (IPHRC), Pertubuhan Kerjasama Islam (OIC) dari 26 hingga 30 November 2023. Sesi ini dihadiri oleh pihak-pihak berkepentingan termasuk wakil IPHRC, pakar daripada organisasi antarabangsa, wakil OIC serta negara pemerhati termasuk Institusi Hak Asasi Manusia Kebangsaan (NHRI).

Satu perbahasan tematik tentang ‘Penghapusan Diskriminasi Kaum: Perspektif Islam dan Hak Asasi Manusia’ anjuran bersama IPHRC-OIC dengan kerjasama Suruhanjaya Hak Asasi Manusia Arab Saudi (SHRC) dalam satu sesi, telah membincangkan langkah-langkah yang perlu diambil bagi menangani bahana diskriminasi yang semakin meningkat, termasuk diskriminasi kaum dan pelbagai manifestasinya yang kontemporari. SUHAKAM, yang diwakili oleh Pesuruhjaya Puan Nazira Abdul Rahim telah menyampaikan satu kenyataan intervensi.

“Rasisme, diskriminasi kaum dan xenofobia tidak mempunyai tempat dalam mana-mana masyarakat bertamadun dan kegagalan untuk menangani isu ini boleh membawa kepada situasi yang lebih ganas seperti yang sedang berlaku di Palestin. Penerimaan dan pengampunan negara kuasa besar terhadap amalan apartheid, pendudukan haram, keperluan asas manusia yang dinafikan dan hukuman secara kolektif terhadap orang awam di Palestin, separuh daripada mereka adalah kanak-kanak, dikutuk oleh SUHAKAM. Sesungguhnya, keganasan yang menyebabkan kehilangan nyawa, kemusnahan keseluruhan keluarga hanya akan menyebabkan kehilangan harapan dan trauma yang berkekalan. Tindakan keganasan, pembunuhan, kemusnahan infrastruktur awam termasuk kemudahan kesihatan di Gaza, bangunan kediaman dan rumah ibadat adalah pelanggaran serius terhadap undang-undang dan adat yang berlaku dalam konflik bersenjata antarabangsa, ke dalam rangka kerja undang-undang antarabangsa yang ditetapkan”.

Cadangan-cadangan utama dalam perbahasan akan dimuktamadkan oleh SHRC dan disatukan ke dalam satu dokumen yang dipersetujui bagi menggalakkan dialog dan perkongsian amalan terbaik dalam memerangi diskriminasi kaum. Adalah penting untuk memupuk budaya toleransi, kesaksamaan dan tiada diskriminasi ke arah membangunkan masyarakat yang adil, aman dan mampan pada masa hadapan, dalam mencapai matlamat ini, penggubalan undang-undang berkaitan yang memberi tumpuan kepada penambahbaikan, melindungi dan menggalakkan hubungan kaum/etnik yang bermanfaat harus diwujudkan. Pelaksanaan undang-undang ini perlu dipantau secara berkesan bagi menggalakkan keharmonian negara, perpaduan, rekonsiliasi, integrasi dan tiada diskriminasi dalam masyarakat. Melihat Pelan Tindakan Perpaduan Negara 2021-2030 pada tahun 2021 serta keadaan semasa, SUHAKAM menyeru kepada Kerajaan untuk melihat semula keputusan Rang Undang-Undang Keharmonian Nasional yang telah dihentikan sebelum ini.

Dalam membawa Perkara 8 Perlembagaan Persekutuan sebagai asas perlindungan perlembagaan untuk kesaksamaan dan tiada diskriminasi, SUHAKAM menyeru semua pihak untuk memerangi perkauman, diskriminasi kaum, dan xenofobia di Malaysia. SUHAKAM juga akan terus bekerjasama dengan OIC-IPHRC dan pihak berkepentingan lain yang berkaitan untuk menganjurkan beberapa aktiviti kesedaran, konsultasi, serta program yang bertujuan untuk menangani isu-isu perkauman dan xenofobia yang semakin meningkat.

Press Statement No. 45-2023_ SUHAKAM Bill 2023 Marks Milestone in Empowering Human Rights in Malaysia

KUALA LUMPUR (29 NOVEMBER 2023) – The first reading of the Human Rights Commission of Malaysia Amendment Bill 2023 (SUHAKAM Bill 2023) on 27 November 2023 marked a significant milestone and today, the second reading will determine the future of human rights in Malaysia and simultaneously reflect the Government’s commitment and aspiration towards the protection of human rights in the country. 

SUHAKAM wishes to express its gratitude to YB Dato’ Sri Azalina Binti Othman Said, Minister in the Prime Minister’s Department (Law and Institutional Reform) for her relentless effort in bringing the Human Rights agenda forward through institutional reforms. We also wish to convey our sincere appreciation to the Legal Affairs Division of the Prime Minister’s Department (BHEUU) for conducting the engagement session with Members of Parliament (MPs) and Senators to present the proposed amendments. The session has served as a platform for MPs and Senators to share their views and concerns over the 11 proposed amendments aimed at strengthening the role and authority of the Commission, to better safeguard and promote human rights within the country. SUHAKAM takes this opportunity to thank all representatives for their commitment and support to empower the Commission through legislative changes.

This Bill, which seeks to reinforce the role and authority of SUHAKAM, was designed to ensure diverse representation and establish an independent, integral organization to effectively address human rights issues across Malaysia. It is important for SUHAKAM, as an independent NHRI to reflect on the balanced composition of the Commissioners that have the ability to promote and protect the rights of children, women and persons with disabilities. In addition to this, the Bill will also strengthen the role of the Children Commissioner by institutionalizing and expanding the Office of Children’s Commissioner (OCC) within SUHAKAM. Cementing the existence of the OCC within SUHAKAM gives legitimacy and certainty from the Government to the public on our commitment to protect and promote children’s rights.

SUHAKAM would like to thank all stakeholders including the Government Agencies, CSOs and NGOs for their cooperation, contribution and unwavering effort in the preparation of this comprehensive amendment to SUHAKAM founding Act (SUHAKAM Act 1999). In anticipating the Bill’s second reading, SUHAKAM recognizes the crucial role it plays in further empowering the organization and augmenting its capabilities in upholding and advancing human rights in Malaysia. SUHAKAM will continue to carry out it functions independently and with integrity by ensuring continuous accountability in promoting and protecting human rights in Malaysia.

RUU SUHAKAM 2023, Tanda Aras Pencapaian Dalam Memperkasakan Hak Asasi Manusia di Malaysia

KUALA LUMPUR (29 NOVEMBER 2023) – Bacaan pertama Rang Undang-Undang Pindaan Suruhanjaya Hak Asasi Manusia Malaysia 2023 (RUU SUHAKAM 2023) pada 27 November 2023 merupakan satu peristiwa penting dan hari ini, bacaan kedua akan menentukan masa depan hak asasi manusia di Malaysia dan sekaligus mencerminkan komitmen dan aspirasi kerajaan terhadap perlindungan hak asasi manusia di negara ini. 

SUHAKAM ingin mengucapkan terima kasih kepada YB Dato’ Sri Azalina Binti Othman Said, Menteri di Jabatan Perdana Menteri (Undang-undang dan Reformasi Institusi) atas usaha beliau dalam membawa agenda hak asasi manusia melalui reformasi institusi. Kami juga ingin menzahirkan penghargaan kepada Bahagian Hal Ehwal Undang-undang Jabatan Perdana Menteri (BHEUU) yang mengadakan sesi libat urus dengan Ahli Parlimen (Ahli Parlimen) dan Senator untuk membentangkan pindaan yang dicadangkan. Sesi ini telah menjadi  satu platform untuk berkongsi pandangan terhadap 11 pindaan yang dicadangkan yang bertujuan untuk mengukuhkan peranan dan kuasa Suruhanjaya, bagi melindungi dan mempromosikan hak asasi manusia di negara ini dengan lebih baik. SUHAKAM mengambil kesempatan ini untuk mengucapkan terima kasih kepada semua wakil atas komitmen dan sokongan mereka untuk memperkasakan Suruhanjaya melalui perubahan legislatif.

RUU yang bertujuan untuk mengukuhkan peranan dan kuasa SUHAKAM ini dibentuk supaya  Pesuruhjaya yang dilantik adalah terdiri daripada  pelbagai latar belakang.  Di samping itu,  RUU ini akan dapat memastikan SUHAKAM berfungsi sebagai sebuah organisasi bebas dan bersepadu untuk menangani isu hak asasi manusia secara berkesan di Malaysia. Kebebasan sesebuah NHRI adalah penting sebagai penyeimbang komposisi antara Pesuruhjaya dalam mempromosi dan melindungi hak kanak-kanak, wanita dan orang kurang upaya. Justeru, RUU ini akan turut bertindak sebagai pengukuh peranan Pejabat Pesuruhjaya Kanak-kanak (OCC) dalam SUHAKAM, sebagai tanda aras komitmen Kerajaan dalam melindungi dan mempromosi hak kanak-kanak kepada orang ramai

SUHAKAM mengucapkan terima kasih kepada pihak berkepentingan termasuk agensi kerajaan, CSO dan NGO atas kerjasama, sumbangan dan usaha yang tidak berbelah bahagi dalam penyediaan pindaan komprehensif Akta SUHAKAM 1999 (Akta 597). Dalam bacaan kedua rang undang-undang ini, SUHAKAM sedar akan kepentingan peranannya dalam memperkasa organisasi dan meningkatkan keupayaannya dalam menegak dan memajukan hak asasi manusia di Malaysia. SUHAKAM akan terus menjalankan fungsinya secara bebas dan berintegriti dengan memastikan akauntabiliti yang berterusan terhadap perjuangan hak asasi manusia di Malaysia.
