PRESS STATEMENT
KUALA LUMPUR (10 FEBRUARY 2021) – The Human Rights Commission of Malaysia (SUHAKAM) is disturbed by the recent media reports of alleged assault on a civilian by police officers based on the suspicion that he was involved with smuggling cigarettes.
While the country is now in the state of emergency, this does not warrant the abuse of power by any parties in any situation. The abuse of power by the law enforcement authorities is not something new. Between 2015-2020, SUHAKAM has received a total of 479 complaints relating to excessive use of force and abuse of power by the police force.
In accordance with the United Nations Office for Drugs and Crime (UNODC) Handbook on Police Accountability, Oversight and Integrity, SUHAKAM is of the view that an effective review process by an enforcement oversight body is crucial particularly in addressing cases of misconduct concerning excessive or unlawful use of force and firearms by police officers. SUHAKAM wishes to highlight that the use of force should only be necessary and proportionate to the law enforcement’s objective and the level of resistance encountered.
In this regard, SUHAKAM calls for the early enactment of the Independent Police Conduct Commission (IPCC) Bill and call on the Government to ensure that the IPCC Bill incorporates the substantive essence of the Independent Police Complaints and Misconduct Commission (IPCMC) Bill 2019 and the recommendations from the 2005 Royal Commission to Enhance the Operation and Management of the Royal Malaysian Police. SUHAKAM is convinced that the establishment of a more independent, free and transparent body will go a long way in restoring and enhancing the public confidence in the police force.

KUALA LUMPUR (10 FEBRUARI 2021) – Suruhanjaya Hak Asasi Manusia Malaysia (SUHAKAM) menzahirkan kebimbangan dengan laporan media baru-baru ini berhubung dakwaan serangan anggota polis terhadap seorang lelaki kerana dia disyaki terlibat dalam penyeludupan rokok.
Walaupun negara kita kini berada dalam keadaan darurat, ini tidak bermakna mana-mana pihak boleh menyalahgunakan kuasa mereka dalam apa jua keadaan. Penyalahgunaan kuasa oleh pihak berkuasa bukanlah sesuatu yang baharu. Antara tahun 2015-2020, SUHAKAM telah menerima sejumlah 479 aduan berhubung penggunaan kekerasan yang melampau dan salah guna kuasa oleh pihak polis.
Selaras dengan Panduan Pejabat Pertubuhan Bangsa-Bangsa Bersatu bagi Hal Ehwal Dadah dan Jenayah (UNODC) mengenai Kebertanggungjawapan, Pengawasan dan Integriti Polis, SUHAKAM berpandangan bahawa proses semakan yang berkesan oleh sebuah badan pengawasan penguatkuasaan amat penting terutamanya dalam menangani kes-kes salah laku berkaitan penggunaan kekerasan dan senjata api yang melampau atau menyalahi undang-undang oleh pegawai polis. SUHAKAM ingin menekankan bahawa penggunaan kekerasan haruslah hanya mengikut keperluan dan bersekadar dengan objektif dan tahap tentangan yang dihadapi.
Dalam hal ini, SUHAKAM menyeru agar penggubalan Rang Undang-Undang (RUU) Suruhanjaya Bebas Tatakelakuan Polis (IPCC) 2020 disegerakan dan Kerajaan perlu memastikan agar RUU IPCC ini merangkumi intipati Rang Undang-Undang Suruhanjaya Bebas Aduan dan Salah Laku Polis (IPCMC) 2019 serta syor-syor Suruhanjaya Diraja Penambahbaikan Perjalanan dan Pengurusan Polis Diraja Malaysia (PDRM) 2005. SUHAKAM yakin bahawa penubuhan satu badan yang lebih bebas, adil dan telus akan mengembalikan dan meningkatkan keyakinan rakyat terhadap pasukan polis.
